REQUEST FOR COUNCIL ACTION

DATE: 9.26.94

ITEM NO.: B-5

Manager Reviewed:

Agenda Section:

Department Approval:
\V\~

~

Item Description:

Consent
Randall Molin request for a minor variance at 2447
Chatsworth.

Background:

1. The property lUlder consideration at 2447 Chatsworth is zoned R.l, single
family, and is in the area where the 1994 pavement management program is
under construction. City ordinances require that driveways be setback 5 feet
from the side lot line.

2. The Molin's driveway currently is 3 feet, 4 inches from their side property
line and has been in this location for 35 years. A passed pavement
management program, located the curb for their driveway in its present
location when curb and gutter was constructed on Chatsworth. The Molin's
would like to resurface their driveway and would like to keep it in the same
location that it is now.

3, The Minor Variance Committee has reviewed this application and has
unanimously recommended approval of the 1 foot, 8 inch sideyard setback
variance. It was the Committee's belief that moving the curb cut opening
would be a significant hardship for the Molin's. It was also felt that the
existing wood fence along the property line mitigates the effects of the side
yard setback variance request.

4. All affected adjacent property owners indicated their approval of the
proposed variance.

Alternptives:

1. Deny the variance based on [mdings that no hardship or practical difficulty
