The property lUlder consideration at 2447 Chatsworth is zoned R.l, single <br />family, and is in the area where the 1994 pavement management program is <br />under construction. City ordinances require that driveways be setback 5 feet <br />from the side lot line. <br /> <br />2. The Molin's driveway currently is 3 feet, 4 inches from their side property <br />line and has been in this location for 35 years. A passed pavement <br />management program, located the curb for their driveway in its present <br />location when curb and gutter was constructed on Chatsworth. The Molin's <br />would like to resurface their driveway and would like to keep it in the same <br />location that it is now. <br /> <br />3, The Minor Variance Committee has reviewed this application and has <br />unanimously recommended approval of the 1 foot, 8 inch sideyard setback <br />variance. It was the Committee's belief that moving the curb cut opening <br />would be a significant hardship for the Molin's. It was also felt that the <br />existing wood fence along the property line mitigates the effects of the side <br />yard setback variance request. <br /> <br />4. All affected adjacent property owners indicated their approval of the <br />proposed variance. <br /> <br />Alternptives: <br /> <br />1. Deny the variance based on [mdings that no hardship or practical difficulty <br />
