The property under consideration at 1223 Rose Place is zoned R - 2 Two <br />Family Residential and is a part of a townhome development. City <br />ordinances require sideyard setbacks for buildings be 10 feet from the side lot <br />line. <br /> <br />2. Ms. Wirrer currently has an at grade deck on the west side of her townhome. <br />This deck is 8 feet wide and extends to within 6 feet of her west property line. <br />For health reasons, she is proposing to enclose an 8x14 foot portion of her <br />deck and possibly remove the remaining portion of the deck. <br /> <br />3. The Minor Variance Committee has reviewed this application and has <br />unanimously recommended approval of the 4 foot sideyard setback variance <br />requested by Ms. Wirrer. It was the Committee's belief that the interior <br />layout of the townhome would prevent the patio from being located in any <br />other location. The plans for this patio enclosure have been reviewed by the <br />townhome neighborhood association and found to be consistent with the <br />overall development plans. <br /> <br />4. All affected adjacent property owners indicated their approval of the <br />proposed variance. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on findings that no hardship or practical difficulty <br />exists 011 the site. <br /> <br />1 <br />
