When the required additional cul-de-sac right-of-way property <br />was negotiated for, one of the conditions was that this segment of the T-intersection would be vacated at <br />the appropriate time. The payment for the easement was reduced by the appropriate amount based on <br />$2.00 a square foot being credited to the City ofRoseville for the vacated portion of the T-intersection. <br /> <br />In 1970, the sanitary sewer main was constructed through a portion of the property abutting the T- <br />intersection. The existing depths of the inplace sewer line would al10w the city to release part of the <br />easement and still be able to maintain the sewer without encroaching on private property. The property <br />owner that woutd receive the vacated portion of the T-intersection and the release of the stonn sewer <br />easement has expressed an interest in dealing with the abutting property owner to subdivide the area into <br />a buildable lot. <br /> <br />Policy objectives: It has been the City's practice to vacate right-of~way or release partial easements <br />when they are no longer needed and wiH have the potentia! for a buildable lot. The proposed assessment <br />for the reconstruction of Milton Street would benefit the abutting property if the vacant land were made <br />buildable. <br /> <br />Staff recommendation: Approval of a resolution vacating a portion of Milton Street and the approval <br />of a partial release of easement over the abutting, vacated portion of Milton Street. <br /> <br />RECOMMENDED COUNCIL ACTION: <br /> <br />Motion to approve a res,olution vacating the easterly leg of the T -intersection for Milton Street and the <br />release of the north 14 feet ofa storm sewer easement recorded under document No. 543664 dated <br />February 13, 1970. <br /> <br />Prepared by: Doug Strong <br />
