The City is currently considering an amendment to the Comprehensive Plan to relocate
the proposed future Twin Lakes Parkway to the south of its current planned location.
This would eliminate the need for the lona Lane right-of-way with the exception of the
need for a 40 foot wide easement for the sanitary sewer interceptor and City
underground utilities. If vacated, the right-of-way would revert back to the adjacent
property owners on the north and south of the lona Lane right-of-way. To the north is
the Ryan Company site, presently being developed. On the south is the Old Dominion
trucking terminal site. Ryan Company's portion of the vacated right-of~way could be
used for temporary or permanent storm water ponding. There are no plans for
immediate use of the property by Old Dominion.

Staff R~commendation:

If the Comprehensive Plan is changed and the right-of-way is no longer needed for
Twin Lakes Parkway, the proposed right-of-way would not be needed for public
purposes. Therefore, staff recommends approval of a resolution to vacate the right-of-
way, subject to retention of a 40 foot drainage and utility easement.

Planning Commission Recommendations:

The Planning Commission, at the October 9, 1996 meeting, unanimously recommended
that the City Council approve the vacation of the portion of the unimproved, dedicated
and City owned right-of-way of lona Lane lying east of Cleveland, west of Hyman
Freig, htways north of the Old Dominion truck terminal site, and south of the former
Midwest Motor Express site subject to maintenance of a 40 foot utility and drainage
easement and subject to approval of a Comprehensive Plan amendment to realign
Twin Lakes Parkway.

Council Action Requested:

1. On October 14, 1996, open the public hearing on this matter, take testimony and
then continue the pUblic hearing on this matter until October 28, 1996 for a
second reading.

2. On October 28, 1996, take additional testimony, close the hearing, and adopt a
resolution to vacate a portion of the unimproved, dedicated, and City owned
right-of-way of lona Lane, east of Cleveland Avenue, subject to retention of a 40
foot drainage and utility easement.

Staff Report by: Rick Jopke, Assistant Community Development Director (490-2241).

2
