Snelling Avenue. Background 1. Signcrafters Inc. have been employed by'the Acby's Restaurant at 2105 N. Snelling Avenue to install an electronic silent radio system. The silent radio system is a L,E.D. message board which they are proposing to locate over their drive through pickup window. The purpose of the silent radio system is to provide information to the Arby's customer while they are waiting in line to pick up their purchases. 2. Section 14.040 of the Roseville City code states that "signs giving off intermittent or rotating beams shall not be permitted in any district. Where the message or graphic content of a sign can be changed by mechanical or electronic means, such message may not change more than once every 24 hours, except messages displaying time and temperature". In order to install this information device, a variance to Section 14.040 must be granted by the City. Development Spmmary 1. The Arby's Restaurant is located at 2105 N. Snelling Avenue. The property under consideration is guided for business purposes and is zoned B-3 General Commercial. The existing sign package for the restaurant includes a pylon sign, wall signage, a menu board, and miscellaneous directional signs. The silent radio system is 12 inches tall and 72 inches long and is proposed to be mounted over the drive through pick up window. With the L.E.D. system, the silent radio will be displaying continuous information ranging from current news headlines, sports results, and product promotion ftom the Arby's Restaurant. The message board will not be seen ftom the street and given its size and low intensity lighting, is intended to be seen only from a few car lengths away in distance. The neighboring property to the west is an apartment complex, located in excess of300 feet from the sign. 2. The Roseville 'City code states that applications for variances may be considered where there are practical difficulties or unusual hardships in the way of carrying out the strict letter of the provisions of the code. In this particular case, there is no hardship. The applicant is ofthe opinion that the practical difficulty is that the sign regulations preclude the use of new technology. The intent of the sign codes prohibition against flashing signs is to prevent traffic safety concerns and disruptions to adjacent properties. In this particular case, the silent radio system does not face a public street and is located on the restaurant site such that it will not be seen by any adjoining properties,
