The intent of the sign codes prohibition against flashing signs is <br />to prevent traffic safety concerns and disruptions to adjacent properties. In <br />this particular case, the silent radio system does not face a public street and is <br />located on the restaurant site such that it will not be seen by any adjoining <br />properties. <br /> <br />3. Suml\lary and Conclusions <br /> <br />It is difficult for City codes and ordinances to anticipate the impact of new <br />and emerging technologies, The silent radio system proposed for the Arby's <br />Restaurant is intended to be used to disseminate infonnation to customers <br />waiting in the drive through lane. Given the systems location, size, and <br />intensity of lighting, it will not be seen from a public street or ITom <br />surrounding adjacent properties. Given this minimal impact, staff <br />recommends approval of a variance to Section 14.040 of the City code <br />allowing messages to change more than once every 24 hours for the silent <br />radio system proposed for the Arby's Restaurant at 2105 N.
