The City of Roseville has received a request trom Independent School District #623 and <br />Harstad Homes to vacate a roadway easement that traverses the common property line <br />between their two properties. This roadway easement was granted in favor of Rose <br />Township before the turn of the century. This roadway easement is no longer necessary <br />and must be vacated before the plats for Independent School District #623 and Harstad <br />Homes can be filed and building permits issued. <br /> <br />2. It was common practice to establish roadway easements along section lines, In this area, <br />Owasso Boulevard runs east and west and turns into Western Avenue to move south <br />around this property. The new plats for the School District and Harstad Homes have <br />street alignments serving their properties in different locations, eliminating the need for <br />this roadway easement. <br /> <br />3. A legal description of the old roadway easement has been prepared by the Ramsey County <br />Surveyor and is included in the attached vacation resolution. Engineering staff has been in <br />contact with the Ramsey County Surveyor's office regarding this vacation and the County <br />has indicated their concurrence with this vacation. When the City Council approved the <br />planned unit development and plat for Harstad Homes, a condition of approval inc1uded <br />adequate right-of-way for proper design of the intersection of West em Avenue, Owasso <br />Boulevard, and High Point Curve. The legal description for the right-of-way to be <br />vacated retains adequate area for this intersection. <br /> <br />Sta~ Recommendations: <br /> <br />1. It is recommended that the City Council approve the resolution vacating that portion of <br />the roadway easement that traverses the common property line between Independent <br />School District #623 and Harstad Homes Inc. generally west of the intersection of Ow as so <br />Boulevard South and Western Avenue. <br /> <br />.' <br />rfl <br /> <br />1 <br />
