<br />PLANNED UNIT DEVELOPMENT AGREEMENT <br /> <br />AGREEIvffiNT, dated II:lI q5 between the City of RosevilIe (lithe City") and <br />Masterpiece Homes, Inc. (" eveloper1l). <br /> <br />1. Request for Planned Unit Development Approval. <br /> <br />Masterpiece Homes Inc. request for concept approval of a planned unit development <br />consisting of 16 townhomes, a rezoning from R-1 to residential Planned Unit <br />Development (PUD), and preliminary and final plat approval on land located at 1061 <br />Roselawn Avenue. Masterpiece Homes, Inc. also requests a change in the <br />Comprehensive Plan map designation of the site from low density residential to medium <br />density residential. <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development <br />consisting of 16 townhomes on land located at 1061 Roselawn Avenue. The subject <br />property is legally described as follows: <br /> <br />All that part of the south half of the southwest quarter of the northwest quarter of Section 14, <br />Township 29, Range 23 lying east of Lexington Avenue more particularly described as: Beginning <br />at a point on the easterly line of Lexington Avenue where the center line of said section intersects said <br />line; thence northerly along the easterly line of Lexington Avenue 328,37 feet~ thence easterly 621.54 <br />feet to a point 328.24 feet north of the south line of said South Half of the Southwest Quarter of the <br />Northwest Quarter of Section 14; thence southerly 328.24 feet to a point on the center line of said <br />section 621.40 feet east ofthe point of beginning; thence westerly 621.40 feet to point of beginning. <br />EXCEPT the west 183.00 feet of said South Half of the Southwest Quarter of the Northwest <br />Quarter, according to the United States Government Survey thereof and situate in Ramsey County, <br />Minnesota. <br /> <br />2. Planned Unit Development Approval. <br /> <br />The CITY hereby grants approval of the Fina! Development Plan subject to the <br />DEVELOPER'S compliance with the terms and conditions of this agreement. The <br />CITY agrees to approve applications for building pennits, provided that said plans are <br />consistent with the exhibits which were approved at the concept and final stage of the <br />Planned Unit Development process, and all of the conditions of this agreement have <br />been satisfied. <br /> <br />3. Approval by the CITY. <br /> <br />The CITY hereby approves the Development as shown on the following exhibits. The <br />DEVELOPER shall develop the subject properties in accordance with the general plans <br />shown on the exhibits. If, however, the exhibits vary from the written tenns of this <br />Agreement, the written tenus shall controL The exhibits marked approved by the City <br />
