PLANNED UNIT DEVELOPMENT AGREEMENT AGREEIvffiNT, dated II:lI q5 between the City of RosevilIe (lithe City") and Masterpiece Homes, Inc. (" eveloper1l). 1. Request for Planned Unit Development Approval. Masterpiece Homes Inc. request for concept approval of a planned unit development consisting of 16 townhomes, a rezoning from R-1 to residential Planned Unit Development (PUD), and preliminary and final plat approval on land located at 1061 Roselawn Avenue. Masterpiece Homes, Inc. also requests a change in the Comprehensive Plan map designation of the site from low density residential to medium density residential. The DEVELOPER has asked the CITY to approve a Planned Unit Development consisting of 16 townhomes on land located at 1061 Roselawn Avenue. The subject property is legally described as follows: All that part of the south half of the southwest quarter of the northwest quarter of Section 14, Township 29, Range 23 lying east of Lexington Avenue more particularly described as: Beginning at a point on the easterly line of Lexington Avenue where the center line of said section intersects said line; thence northerly along the easterly line of Lexington Avenue 328,37 feet~ thence easterly 621.54 feet to a point 328.24 feet north of the south line of said South Half of the Southwest Quarter of the Northwest Quarter of Section 14; thence southerly 328.24 feet to a point on the center line of said section 621.40 feet east ofthe point of beginning; thence westerly 621.40 feet to point of beginning. EXCEPT the west 183.00 feet of said South Half of the Southwest Quarter of the Northwest Quarter, according to the United States Government Survey thereof and situate in Ramsey County, Minnesota. 2. Planned Unit Development Approval. The CITY hereby grants approval of the Fina! Development Plan subject to the DEVELOPER'S compliance with the terms and conditions of this agreement. The CITY agrees to approve applications for building pennits, provided that said plans are consistent with the exhibits which were approved at the concept and final stage of the Planned Unit Development process, and all of the conditions of this agreement have been satisfied. 3. Approval by the CITY. The CITY hereby approves the Development as shown on the following exhibits. The DEVELOPER shall develop the subject properties in accordance with the general plans shown on the exhibits.
