or for safety precautions or programs, or responsibility for CONTRACTOR's failure to perform the work in accordance with the Contract Documents and in particular the specific limitations set forth in paragraph 1.6 of the Agreement are applicable. The duties and responsibilities of the RPR are limited to those of ENGINEER in ENGINEER's agreement with the OWNER and in the construction Contract Documents, and are generally described as below: RPR is ENGINEER's agent at the ~itet will act as directed by and under the supervision of ENGINEER, and will confer with ENGINEER regarding RPR's actions. RPR's dealings in matters pertaining to the on-site work shall in general be with ENGINEER and CONTRACTOR keeping OWNER advised as necessary. RPR's dealings with subcontractors shall only be through or with the full knowledge and approval of CONTRACTOR. RPR shall generally communicate with OWNER with the knowledge of and under the direction of ENGINEER. SC-9.10. Delete Paragraph 9.10 of the General Conditions in its entirety and insert the following in its place: 9.10. ENGINEER will have authority to determine the actual quantities and classifications of items of Unit Price Work performed by CONTRACTOR, and the written decisions of ENGINEER on such matters will be final, binding on OWNER and CONTRACTOR and not subject to appeal (except as modified by ENGINEER to reflect changed factual conditions). SC-ll-1. Change of Contract Price is modified by adding the adding the following: 11.1.1. The Owner will not reimburse the Contractor for payroll costs due to down time. It shall be the Contractor's responsibility to utilize his employees on other portions of the work, when any delays occur. The payroll cost of employees actually involved in the approved extra work, plus fringe benefits as indicated in 11.4.1 shall be included in the Cost of the Work. The Engineer shall record the actual working hours and the employees names for the extra work. 11.1.2. The Owner will not reimburse the contractor for equipment and/or machinery costs due to down time. It shall be the contractor's responsibility to utilize the equipment and/or machinery on other portions of the work, when any delays occur.
