<br />or for safety precautions or programs, or responsibility for <br />CONTRACTOR's failure to perform the work in accordance with the <br />Contract Documents and in particular the specific limitations set <br />forth in paragraph 1.6 of the Agreement are applicable. <br /> <br />The duties and responsibilities of the RPR are limited to those of <br />ENGINEER in ENGINEER's agreement with the OWNER and in the <br />construction Contract Documents, and are generally described as <br />below: <br /> <br />RPR is ENGINEER's agent at the ~itet will act as directed by and <br />under the supervision of ENGINEER, and will confer with ENGINEER <br />regarding RPR's actions. RPR's dealings in matters pertaining to <br />the on-site work shall in general be with ENGINEER and CONTRACTOR <br />keeping OWNER advised as necessary. RPR's dealings with <br />subcontractors shall only be through or with the full knowledge <br />and approval of CONTRACTOR. RPR shall generally communicate with <br />OWNER with the knowledge of and under the direction of ENGINEER. <br /> <br />SC-9.10. <br /> <br />Delete Paragraph 9.10 of the General Conditions in its entirety <br />and insert the following in its place: <br /> <br />9.10. ENGINEER will have authority to determine the actual <br />quantities and classifications of items of Unit Price Work <br />performed by CONTRACTOR, and the written decisions of <br />ENGINEER on such matters will be final, binding on OWNER <br />and CONTRACTOR and not subject to appeal (except as <br />modified by ENGINEER to reflect changed factual <br />conditions). <br /> <br />SC-ll-1. <br /> <br />Change of Contract Price is modified by adding the <br />adding the following: <br /> <br />11.1.1. The Owner will not reimburse the Contractor <br />for payroll costs due to down time. It shall <br />be the Contractor's responsibility to utilize <br />his employees on other portions of the work, <br />when any delays occur. The payroll cost of <br />employees actually involved in the approved <br />extra work, plus fringe benefits as indicated <br />in 11.4.1 shall be included in the Cost of the <br />Work. The Engineer shall record the actual <br />working hours and the employees names for the <br />extra work. <br /> <br />11.1.2. The Owner will not reimburse the contractor <br />for equipment and/or machinery costs due to <br />down time. It shall be the contractor's <br />responsibility to utilize the equipment and/or <br />machinery on other portions of the work, when <br />any delays occur. However, the rental cost of <br />equipment and/or machinery actually performing <br />work shall be included in the Cost of the <br />Work, when extra work is approved.
