Chairman Wietecki closed the public hearing. Resolution 8/9/95a Chairman Wietecki offered the following motion which was seconded by Member Harms. WHEREAS, Burlington Northern Railroad right-of-way forms the ITont or south property line along the structure and lot at 337 South Owasso Boulevard, and WHEREAS, the ITout or south side setback from the Burlington Northern railroad right- of-way front property line is five feet, and WHEREAS, the Burlington Northern railroad right-of-way prohibits further encroachment or further development, and WHEREAS, the lot area is consistent with adjacent properties, and the proposed structure will be set back ITom the shoreland a distance similar to adjacent structures, and WHEREAS, the proposed structure would encroach no closer than the existing structurally unsound structure to Lake Owasso's shoreline, now THEREFORE, BE IT RESOLVED, that the City ofRoseville Planning Commission recommends approval of a variance to John Torgerson at 337 South Owasso Boulevard, to allow the existing structure to be torn down and a new structure to be built at the same 21 foot setback from the shoreline for the foundation wall of the house and with a 15 feet setback ITom the Lake Owasso shoreline for the deck, and 5 feet for the south or ftont property line setback for a garage, but requiring a 5 foot minimum setback on both side lot property lines. ROLL CALL: Ayes: Wietecki, Harms, Sandstrom, Rhody, Cunningham Nays; None. Chairman Wietecki explained that this case was a special case in an older, previously developed area with preexisting lots of record. 14
