REQUEST FOR COUNCIL ACTION

DATE: 05-22-95

ITEM NO.: B-3

Department Approval:

;r;p~ I rf\ r:

Item Description:

Manager Reviewed:

Agenda Section:

Consent
Donald and Sophie Gillmor request for a minor variance at 2016 N.
Wheeler Street.

Background

1. The property under consideration at 2016 N. Wheeler Street is zoned R-l single family. It
is located in an area where the pavement management program will be reconstructing
streets this summer. It is a corner lot and as such, the sideyard setbacks for driveways
must be 30 feet ITom the side street right-of-way line. In this case, the existing driveway is
11 feet from the sideyard property line.

2. The Minor Variance Committee has reviewed this request and has unanimously
recommended approval ofa 21 foot sideyard setback variance at 2016 N. Wheeler Street
to allow the existing driveway to remain in its present location. It was the Committee's
belief that moving the driveway would make access to the single car garage impossible and
would require the removal of existing bushes and trees. Because the garage is 2 feet
closer to the sideyard, the Committee recommended approval of a 21 foot sideyard
setback variance.

4. Ail affected adjacent properties have been notified and have given their written consent for
the proposed variance request.

Alternatives:

1. Deny the variance based on findings that no hardships or practical difficulties exist on the
site.

2. Grant the variance based on the findings that a hardship or practical difficulty exists on the
site.

Policy Objectives:

1. Ensure that development occurs consistent with the City's Comprehensive Plan and
Zoning Ordinance.

2. To grant variances where hardships and/or practical difficulties exist.
