<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 05M22M95 <br /> <br />ITEM NO.: <br /> <br />8-5 <br /> <br />Department Approval: <br /> <br />~/~f <br /> <br />Item Description: <br /> <br />Manager Reviewed: <br /> <br />Agenda Section: <br /> <br />Consent <br /> <br />Orvin and Laverne Iverson request for a minor variance at 2754 Dellwood <br />Avenue. <br /> <br />Background <br /> <br />1. The property under consideration at 2754 Dellwood Avenue is zoned R-l single family <br />and is in an area where the pavement management program will be reconstructing streets <br />this summer. It is a corner lot and as such, requires a 30 foot sideyard setback for the <br />driveway. In this case, the angled driveway is within 8 feet of the sideyard property <br />line. <br /> <br />2. The Minor Variance Committee has reviewed this request and has unanimously <br />recommended approval ofa 15 foot sideyard setback variance at 2754 Dellwood Avenue. <br />It was the Committee's belief that during the pavement management program <br />reconstruction of curb and gutter, that this driveway could be straightened out to provide <br />a 90 degree access to the street and still provide access to the existing single car garage. <br />The existing tree to the south of the property could also still be preserved. <br /> <br />4. All affected adjacent properties have been notified and have given consent to the proposed <br />setback variance. <br /> <br />Altern a tive~.i. <br /> <br />1. Deny the variance based on findings that no hardships or practical difficulties exist on the <br />site. <br /> <br />2. Grant the variance based on the findings that a hardship or practical difficulty exists on the <br />site. <br /> <br />Policy Objectives: <br /> <br />1. Ensure that development occurs consistent with the City's Comprehensive Plan and <br />Zoning Ordinance. <br /> <br />2. To grant variances where hardships andlor practical difficulties exist. <br />
