REQUEST FOR COUNCIL ACTION

DATE; 05-22-95

ITEM NO.: B-4

Department Approval:

Manager Reviewed:

Agenda Section:

JI-PiOlmC

Item Description:

Consent
Mildred Groebner request for a minor variance at 2820 Dellwood Avenue,

Background

1. The property under consideration at 2820 Dellwood Avenue is zoned R-I single family.
This property is in an area where the pavement management program will be upgrading
streets this construction season, It is a corner lot and as such, driveway setbacks must be
30 feet from the side street right-of-way line, In this particular case, the driveway is
located 15 feet from the property line.

2. The Minor Variance Committee has reviewed this application and has unanimously
recommended approval ofa 13 foot sideyard setback variance to allow the existing
driveway to remain in its present location. In order to provide access to the existing
garage, the driveway is already canted at the garage door. In addition, there are mature
landscape bushes on both sides of the driveway that would need to be eliminated in order
to move the driveway.

4, All affected adjacent properties have been notified and have given their written consent to
the proposed variance.

Alternatives:

1. Deny the variance based on findings that no hardships or practical difficulties exist on the
site.

2, Grant the variance based on the findings that a hardship or practical difficulty exists on the
site.

Polic.y Objectives:

1, Ensure that development occurs consistent with the City's Comprehensive Plan and
Zoning Ordinance.

2, To grant variances where hardships and/or practical difficulties exist.
