The property under consideration at 2718 DeUwood is zoned R-l single family. It is <br />located at the northeast corner of Dell wood and Woodhill Drive. Streets in this area are <br />being upgraded as a part of the 1995 Pavement Management Program. As a part of this <br />project, Engineering staff a~ways check for proper location of driveways. For corner lots, <br />driveways must be setback 30 feet from the side yard property line adjacent to a street. In <br />cases where the driveway is less than 30 feet from the side yard property line, Engineering <br />staff seek to move the driveway into compliance with the setback requirements or ask the <br />homeowner to apply for a minor variance. In this particular case, the single car detached <br />garage is within 12 feet of the sideyard property line and the driveway is within 14 <br />feet of the side yard property line. <br /> <br />2. The Minor Variance Cominittee has reviewed this request and has unanimously <br />recommended approval of a 18 foot sideyard setback variance for the garage and a 16 <br />sideyard setback variance for the driveway at 2718 Dellwood Street. It was the <br />Committee's belief that moving the driveway to the north away from Woodhill would <br />make the garage inaccessible. In addition, the applicant has a retaining wall on the north <br />side of the driveway with plantings behind the retaining wall. <br /> <br />4. All affected adjacent property owners were notified and have given written consent to the <br />proposed variance. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on findings that no hardships or practical difficulties exist on the <br />site. <br /> <br />2. Grant the variance based on the findings that a hardship or practical difficulty exists on the <br />site. <br /> <br />Policy Objectives: <br /> <br />1. Ensure that development occurs consistent with the City's Comprehensive Plan and <br />Zoning Ordinance. <br /> <br />2. To grant variances where hardships and/or practical difficulties exist. <br />
