REQUEST FOR COUNCIL ACTION

DATE: 06-26-95

ITEM NO.: G-.;1

Department Approval:
JjID/ M?

Manager Reviewed:

Agenda Section:

Item Description:

Hearing

Corpus Christi Church request for a variance to the zoning ordinance at
2131 Fairview Avenue.

BackgrounJl

1. During 1994, the Planning Commission and City Council considered two land use
development applications for the eastern portion of the Corpus Christi Church site. Both
proposals were for multi-family residential development and both involved joint use of the
existing church parking lot, immediately east of the school building. As the development
review process unfolded, both of the applications were withdrawn. The church continues
to have this property on the market searching for an appropriate development proposal.
This eastern parking lot has deteriorated and the church would like to resurface it this
summer.

2. Section 1010.06 of the Design Standards chapter of the City Code requires the periphery
of parking areas and drives shall be constructed with poured in place concrete curbing.
Section 1004.0103b of the City Code requires that when existing parking lots are overlaid
or repaired more than 25%, they are required to meet the design standards currently in
place. Corpus Christi Church, located at Fairview Avenue and County Road B is
proposing to resurface their existing parking lot immediately east of the school building.
Because they are anticipating some development of the northeast corner of their property
and because they assume this future development could involve joint use of the parking
lot, the church is seeking a variance to the curb and gutter requirement for the east, north,
and south edges of the parking lot until such time as the final design of the parking lot can
be determined. Concrete curb can be installed along the western edge in that this location
is already determined and will not need to be modified for future development. In the
past, the City Council has given other churches and institutions a certain time period to
come into compliance with the design standards requiring concrete curb and gutter around
retrofitted parking lots. Typically, this time frame has ranged from 3-5 years. In large
part, these temporary variances have been granted to allow time for the churches to raise
the additional funds to meet the new design standards requirements.

3. The Planning Commission, at the June 14, 1995 meeting, recommended approval of
the variance from City Code Section 10-10.06 to allow uno curb" to be placed
adjacent to the Corpus Christi Church parking lot along the north, south, and east
edges for a period of 5 years from approval.

Staff Recommendation:

1. It is recommended that the City Council approve Corpus Christi Church request for a
variance from City Code Section 10-10.06 to allow "no curb" to be placed adjacent to the
