McGough Construction, Co. is located at 2737 N. Fairview Avenue, just north of County <br />Road "C". At the north end of this property, there currently exists a twenty (20) foot <br />sewer easement within a thirty-three (33) foot road easement that runspe~pendilbular to <br />Fairview Avenue. Being that there will never be a road built in this location, McGough is <br />requesting that the road easement be vacated by the City. <br /> <br />If the road easement were to be vacated, this would give the McGough Construction <br />Company another thirteen (13) feet to the north in which they could build. Being that the <br />sewer easement would still exist, the applicant could not encroach onto this twenty foot <br />right of way. <br /> <br />2. The engineering staff has reviewed this proposal for the vacation of right-of-way and has <br />made one recommendation. This recommendation states that since the 33 foot road <br />easement has a 20 foot sanitary sewer easement over the north 20 feet, this easement will <br />not be vacated. Other than this point, the engineering department has no other concerns <br />with this file. <br /> <br />3. At their July 12, 1995, meeting, the Planning Commission recommended approval of <br />McGough Construction Company's request to vacate the 33 foot road easement at the <br />north property line at 2737 N. Fairview Avenue. <br /> <br />Staff Recommendations: <br /> <br />1. McGough Construction Company, on 2737 N. Fairview Avenue is requesting that a 33 <br />foot road easement be vacated. This action would give McGough an extra 13 feet in <br />which to build. This road easement will never be used in the future, thus giving the City <br />no benefit in holding onto this extra 13 feet. With the understanding that the 20 foot <br />sanitary sewer easement would still remain, it is staffs recommendation that the request <br />for vacation of the road easement on 2737 N. Fairview Avenue be approved. <br /> <br />Council Action Requested: <br /> <br />1. Motion to approve McGough Construction Company's request to vacate the 33 foot road <br />ea~ement along the1r north property line at 2737 N. Fairview <br />Avenue. <br />
