Background <br /> <br />Currently on this site, located at 2720 N, Snelling Avenue, there stands a building that is <br />owned by Khan's Mongolian Restaurant. Recently, the Brick Oven Beanerie Restaurant <br />chain has been interested in buying this property, however the sale of this property is now <br />pending. When a land survey was conducted by W. Brown Land Surveying, Inc., they <br />found that the rear corner of the existing building is encroaching on the twenty (20) ft, <br />north setback of the property. <br /> <br />Being that there is approximately three (3) feet of the building's corner that is encroaching <br />on the twenty ft. setback, the property cannot be legally transferred without a variance <br />from the City, Thus, the Beanerie is requesting that the City ofRoseville grant a variance <br />to the building setback requirement in the zoning ordinance. <br /> <br />2. Engineering Considerations <br /> <br />The Engineering Department has reviewed this variance application and have indicated <br />that the engineering staffhas no concerns about this file. <br /> <br />4 Summary and Conclusions <br /> <br />The existing structure on this site was built with approximately three (3) feet of the <br />building's corner encroaching on the twenty foot minimum setback. As such, the sale of <br />this lot to the Brick Oven Beanerie is pending due to the encroachment. Therefore, it is <br />staff's recommendation that the Beaneries of the Midwest's request for a variance at 2720 <br />N. Snelling Avenue be approved. ' <br /> <br />1 <br />
