PLANNED UNIT DEVELOPMENT AGREEMENT AGREEMENT, dated between the City of Roseville ("the City") and Rich Kettler Construction Inc. ("Developer"). 1. Request for Planned Unit Development Approval. The DEVELOPER has asked the CITY to approve a Planned Unit Development consisting of 44 townhomes on land generally located in the southwest quadrant of County Road C and Dale Street. The subject property is legally described as follows: That part of the East 435 feet of the West Half of Northeast Quarter of Northeast Quarter lying northerly of the following described line; beginning at a point on the west line of said East 435 feet of the West Half distant 590.76 feet south trom the northwest corner thereof; thence easterly to a point on the East line of said East 435 feet of the West Half distant 585.41 feet south trom the northeast corner thereof and said line there terminating, except the North 218 feet; and The West 60 feet of the East 260 feet of the North 218 feet of the East 435 feet of the West Half of the Northeast Quarter of the Northeast Quarter of said Section 11, Township 29, Range 23, Ramsey County, Minnesota, subject to County Road C. and That part of the East Half of the Northeast Quarter of the Northeast Quarter of Section 11, Township 29, Range 23, Ramsey County, Minnesota described as follows: Commencing at a point 33 feet west and 33 feet south of the northeast corner of said East half; thence South 89 degrees 56 minutes, 43 seconds West, assume at a bearing, on a line parallel with the north line of said East Half 164.92 feet to the point of beginning ofthe land to be described; thence continuing South 89 degrees, 56 minutes, 43 seconds West 461.99 feet to the west line of said east Half of Northeast Quarter on Northeast Quarter; thence South 00 degrees, 34 minutes, 30 seconds East 137.09 feet; thence South 89 degrees, 54 minutes 40 seconds East 522.00 feet to the westerly Right of Way line of Dale Street; thence North 00 degrees, 30 minutes, 00 seconds West along said Right of Way line 235.85 feet; thence South 89 degrees, 56 minutes, 43 seconds West 164.94 feet; thence North 00 degrees, 30 minutes, 00 seconds West 200.00 feet to the point of beginning. 2. Planned Unit Development Approval. The CITY hereby grants approval of the Final Development Plan and subject to the DEVELOPER'S compliance with the terms and conditions of this agreement. The CITY agrees to approve applications for building permits, provided that said plans are consistent with the exhibits which were approved at the concept and final stage of the Planned Unit Development process, and all of the - 1 -
