<br />PLANNED UNIT DEVELOPMENT AGREEMENT <br /> <br />AGREEMENT, dated between the City of Roseville ("the City") and Rich Kettler <br />Construction Inc. ("Developer"). <br /> <br />1. Request for Planned Unit Development Approval. <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development consisting of 44 <br />townhomes on land generally located in the southwest quadrant of County Road C and Dale Street. <br />The subject property is legally described as follows: <br /> <br />That part of the East 435 feet of the West Half of Northeast Quarter of Northeast Quarter lying <br />northerly of the following described line; beginning at a point on the west line of said East 435 feet <br />of the West Half distant 590.76 feet south trom the northwest corner thereof; thence easterly to a <br />point on the East line of said East 435 feet of the West Half distant 585.41 feet south trom the <br />northeast corner thereof and said line there terminating, except the North 218 feet; <br /> <br />and <br /> <br />The West 60 feet of the East 260 feet of the North 218 feet of the East 435 feet of the West Half of <br />the Northeast Quarter of the Northeast Quarter of said Section 11, Township 29, Range 23, Ramsey <br />County, Minnesota, subject to County Road C. <br /> <br />and <br /> <br />That part of the East Half of the Northeast Quarter of the Northeast Quarter of Section 11, Township <br />29, Range 23, Ramsey County, Minnesota described as follows: Commencing at a point 33 feet west <br />and 33 feet south of the northeast corner of said East half; thence South 89 degrees 56 minutes, 43 <br />seconds West, assume at a bearing, on a line parallel with the north line of said East Half 164.92 feet <br />to the point of beginning ofthe land to be described; thence continuing South 89 degrees, 56 minutes, <br />43 seconds West 461.99 feet to the west line of said east Half of Northeast Quarter on Northeast <br />Quarter; thence South 00 degrees, 34 minutes, 30 seconds East 137.09 feet; thence South 89 degrees, <br />54 minutes 40 seconds East 522.00 feet to the westerly Right of Way line of Dale Street; thence <br />North 00 degrees, 30 minutes, 00 seconds West along said Right of Way line 235.85 feet; thence <br />South 89 degrees, 56 minutes, 43 seconds West 164.94 feet; thence North 00 degrees, 30 minutes, <br />00 seconds West 200.00 feet to the point of beginning. <br /> <br />2. Planned Unit Development Approval. <br /> <br />The CITY hereby grants approval of the Final Development Plan and subject to the DEVELOPER'S <br />compliance with the terms and conditions of this agreement. The CITY agrees to approve <br />applications for building permits, provided that said plans are consistent with the exhibits which were <br />approved at the concept and final stage of the Planned Unit Development process, and all of the <br /> <br />- 1 - <br />
