Falk and City Council,

The townhomes built should KOT he allowed to remain in their current location. My
reasons:

1. The property line was staked last Fall before construction began and was clearly visible
to even me. If as Mr. Falk has stated that there was some question as to the correctness of
the staking then it should have been resolved before constmction started. This is pure
negligence on the part of the builder.

2. The PUD agreement is binding. What good is an agreement then? Why can't I then build
a garage 1.5' closer than allowed and then come to the city council for an amendment ollly
if someone catches it?

3. The line of townhomes will be offset when the additional homes alongside are built. Mr.
Fa]k even admitted that to some people it would look off but to him 1.5' wouldn't look any
different. Mr. Falk hasn't eyen seen it yet because it isn't built yet!

4. The builders are negligent in other matters. In early March during a wann thaw, the land
was cleared and partiaJly grubbed which exposed much topsoil, dragged much dirt onto the
road, and destroyed the boulevard along a portion of County Road C. This was all done
without erosion control measures or even an erosion control plan. The boulevard hasn't
been repaired yet.

5. Looking at the address map mailed to me with the public hearing notice it appears that
other townhomes will encroach property lines especially 2619 & 2620 Rosetown Court and
659 & 671 Overlook Drive.

~incerely,
Roger Sadecki
