1\
!!

REQUEST FOR COUNCIL ACTION

DATE: 09-25-95

ITEM NO.: G-6

Department Approval:

-:Di72( 1\ \ ~

Item Description:

Manager Reviewed:

~

Agenda Section:

Hearing

Bradley Real Estate request for a vacation of easement at 2100 N. Snelling
Avenue.

Background

1. The Bradley Real Estate Trust owns and operates the Har Mar Mall on Snelling Avenue.
This past summer, building permits were issued for an expansion of the mall to the south.
This work is nearly completed with final preparations being made for the opening of
additional space at the mall. In order to expand the building, it was necessary to reroute
underground utilities around the expanding building. This was accomplished prior to the
actual construction of the building and new utility easements giving the City access for
maintenance and repair of these underground pipes. With the new utilities and easements
in place, the Bradley Real Estate Trust is requesting that the old abandoned easements be
vacated. Since they are no longer used or needed, City staff concurs with this request.

2. The Planning Commission, at the September 13, 1995 meeting, unanimously
recommended approval of Bradley Real Estate request for a vacation of easement at
2100 N. Snelling Avenue.

Staff Recommendations:

1. With the expansion of Har Mar Mall, utilities on the south end of the building have been
rerouted around the new building and easements are in place to insure City access to the
underground utilities. The old easement is of no value to the City and therefore, staff
recommends approval of the Bradley Real Estate Trust request for the vacation of
easement at 2100 N. Snelling Avenue.

Council Action Requested:

1. Motion to adopt attached resolution vacating the utility easement at 2100 N. Snelling
Avenue.

2. Authorize the Mayor and City Manager to execute partial releases of easements.

Staff Report by: Michael Falk

1
