<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 08-28-95 <br /> <br />ITEM NO.: G-4 <br /> <br />Department Approval: <br /> <br />PP0/m~ <br /> <br />Item Description: <br /> <br />Manager Reviewed: <br /> <br />~~ <br /> <br />Agenda Section: <br /> <br />Hearing <br />Independent School District #623 request for vacation of utility easements. <br /> <br />Background <br /> <br />1. When Independent School District #623 assembled land for the second high school site, <br />the district purchased a three lot subdivision along Western Avenue known as "Kalin <br />Addition". That plat was recorded on October 17th, 1961, and contained a five foot <br />utility easement along the rear property line of all three lots. One home was built on lot 3, <br />but has since been sold and moved off the site to make way for the development currently <br />under way. In order to complete final platting, it is necessary to vacate the five foot utility <br />easement. <br /> <br />2. The engineering department has reviewed the school district's request to vacate this <br />easement and have found no reason to maintain these easements. The new plat for the <br />district property incorporates utility and drainage easements around all the property lines <br />of the lots created by the new plat. <br /> <br />3. The Planning Commission, at the August 9, 1995 meeting, approved Independent <br />School District #623 request for a vacation of utility easement along Western <br />Avenue known. as "Kalin Addition". <br /> <br />Staff Recommendations: <br /> <br />1. The easements under consideration with this request for vacation were platted in 1961. <br />The property has subsequently been replatted for residential purposes and the easements <br />are no longer required. In order to clear the way for final platting, it is necessary to adopt <br />a resolution vacating all utility easements in the recorded plat of Kalin Addition. It is <br />staffs recommendation that these easements be vacated. <br /> <br />Council Action Requested <br /> <br />1. Motion to approve the attached resolution vacating the utility easement along Western <br />Avenue known as "Kalin Addition". <br /> <br />1 <br />
