<br />RIGHT-OF-WAY AND UTILITIES EASEMENT

<br />THIS INDENTURE, made this day of , 19_, by and between
<br />Calvary Baptist Church of St. Paul, of the County of Ramsey, State of Minnesota, parties of the
<br />first part, and the CITY OF ROSEVILLE, Ramsey County, Minnesota, a municipal corporation,
<br />party of the second part,

<br />WITNESSETH, that in consideration of the sum of $1.00, in hand paid by the said party
<br />of the second part, said parties of the first part do hereby grant and convey unto party of the
<br />second part, its successors and assigns, a perpetual easement for public road and highway and
<br />for underground utility mains, pipes and appurtenances over, under and across a strip of land}
<br />in the City of Roseville, Ramsey County, Minnesota, as follows:*€~ ~ ~.

<br />which easemenfshall include perpetual right of said City of Roseville, its successors or assigns, .t,J..
<br />to grade, level, fill, drain, pave, build, maintain, and rebuild or widen a public road or highway,
<br />together with such culverts, cuts or ditches as may be necessary, and to construct, maintain,
<br />operate and repair utility mains, pipes and appurtenances over and across a strip of land
<br />hereinbefore described, together with perpetual easement for ingress and egress.
<br />
<br />Party of the first part may place temporary structures such as signs and fences over said
<br />easement area but agrees that in the event that the party of the second part exercises its easement
<br />rights, upon reasonable notice, the party of the first part shall remove such temporary structures,
<br />at its expense.
<br />
<br />TO HA VE AND TO HOLD THE SAME, together with all the hereditaments and
<br />appurtenances thereunto belonging, or in anyway appertaining, to the said party of the second
<br />part, its successors and assigns, Forever.
