The findings, of course, are findings of the Council not the <br />attorney or staff. TheSe sources can only make recommendations. <br /> <br />If this matter is litigation the standards the Court would apply ar~ <br />as follows: <br /> <br />"A city council has broad discretionary power to grant or deny <br />an application for a conditional use permit. .Zylka v. City <br />of Crystal, 283 Minn. 192, 196, 167 N.W.2d 45, 49 (1969). When <br />as in this case, a zoning ordinance expressly authorizes the <br />proposed use by conditional use permit, the city's denial of the <br />permit must be for reasons relating to public health, safety and <br />general welfare, C.R. Investments, Inc. v. Village of Shoreview, <br />304 N.W.2d 320, 324 (Minn. 1981) When a city council <br />states its reasons for denying the permit, we are required to <br />assess the legal sufficiency of the reasons given and to <br />determine whether, if legally sufficient they had a factual <br />basis "Scott Count v Lumber v.
