As you know, on <br />Monday, October 23, 1995, the Roseville City Council voted to table Mr. Bernstein's <br />request for a Permit to develop a Car-X Store at 2215 Snelling Avenue North to <br />prepare findings offact for the denial of Mr. Bernstein's application. Our review of <br />both the facts and the law, strongly suggest that a decision by the City Council to deny <br />the Permit would be arbitrary and improper. <br /> <br />FACTS <br /> <br />On O\.:tober 2, 1995, Jdfrey Bernstein submitted an appiication to the City for <br />a Permit to develop a Car-X Store. During the application process, Mr. Bernstein <br />presented the City with reports from RLK & Associates ("RLK"), who previously <br />submitted similar reports on behalf of the City, relating to potential traffic and noise <br />generation; information relating to Car-X'scompatibility with surrounding businesses; <br />design specifications detailing Car-X's screening devices; and information relating to <br />Car-X's potential impact on surrounding businesses. <br /> <br />The RLK report indicates that Car-X will generate less traffic than an office or <br />retail development, and will not significantly increase the noise level in the surrounding <br />community. Any potential noise aggravation by Car-X would be minimized by the <br />design of the building, which has all garage openings facing South, away from the <br />abutting apartment complexes to the North and West. <br />
