The Public Works Department issued a permit to construct a wet pond <br />without referring to the Planning Department, which was well-aware of the greater <br />neighborhood's and Temple's insistence on a dry pond during the hearing prior to <br />the development. <br /> <br />2. The wet pond has been constructed with a bottom elevation of 827' and an <br />outlet elevation of. 833', i.e. 6' of normal water over a three foot deep clay liner. A <br />pond with such a depth of water adjacent to a slope steeper than 3:1 is certainly a <br />hazardous area. <br /> <br />3. Mr. Aune, employed by the Public Works Department, stated that the <br />Association, being the owners of the pond, is liable for any accidents that occur in <br />the area of the pond. Therefore, the association should take adequate measures to <br />prevent such occurrences. <br /> <br />In light of these facts and of our historical relationship with the greater <br />neighborhood association (you are certainly aware of our longstanding policy: <br />"always cooperate with the neighborhood"), we will try our best to keep children <br />away from the pond and with your pennission, we will place a sign on the slope <br />near the pond: "Do not throw rocks and Do not play near the pond." <br /> <br />Weare looking forward to your efforts to avert possible accidents. <br />
