D. <br /> <br />We request that our garage and driveway remain as is - 8 inches <br />from our east property line because of: <br /> <br />Almost 41 years ago, in 1954, when we bought this property from <br />Angeline Seidenkranz, we had the deed examined by our lawyer <br />before signing any papers. He found ~hat the garage was 4 feet <br />over the property line to the east. When we went to sign the <br />final papers at Twin City Federal, we informed them of this <br />problem and our lawyers recommendation to move the entire 80 <br />foot lot 8 feet to the east to allow a 4 foot clearance from the <br />garage to the property line. Twin City Federal's representative <br />and Mrs. Seidenkranz's lawyer agreed to this but the change was <br />written in at only 4 feet. So, for these 41 years we have been <br />under the assumption that we had the 4 foot clearance and put in <br />our driveway accordingly. <br /> <br />The recent survey in preparation for selling the property to <br />the east of us showed that the change was only 4 feet and the <br />original change was marked from 338 feet to 342 feet instead of <br />346 feet as agreed for our east property line. <br /> <br />As we have maintained the property for these 41 years believing <br />that we had the extra 4 feet, we.xespectfully request that we <br />be granted this minor variance so we don't have to relocate <br />our garage and driveway until such time as the garage is destroyed <br />or has to be rebuilt. <br /> <br />As we are retired and on fixed income, we would be unable to <br />move the garage to comply with the code. We could not afford <br />to do so but would have to sell and move. This we hope does <br />not have to be. <br /> <br />S.
