At the regular meeting ofNov~mber 8, 1995, the Planning Commission <br />moved to recommend that no fonnal recommendation be provided to the <br />Council regarding the establishment of standards concerning deliveries, snow <br />removal,' and trash collection in commercial/industrial areas adjacent to <br />residential areas, but that the following comments be submitted:. <br /> <br />a. Rubbish pickups and deliveries can be scheduled but snow and snow <br />removal cannot be scheduled and should not be regulated. <br />b. Before adopting a new ordinance, there should be work done with <br />adjoining neighbors and the property owners of the centers. <br />c.u Churches and schools also need early plowing. This may add to the <br />confusion of the regulations. <br />d. By limiting the hours of snow removal, trash pickup and delivery, the <br />City places a hardship on public and private owners to either hire <br />additional staff or pay for the late hour plowing. Deliveries can be <br />regulated without such a hardship. <br /> <br />2. There was a feeling that the necessary codes currently exist but need to be <br />enforced. The general prohibition of the nuisance code are broad and should <br />encompass any enforcement problems. <br /> <br />Discussion: <br />1. Based on a review of the current ordinances and the Planning Commission <br />discussions regarding the regulations of snow plowing, rubbish pickup and <br />deliveries in commercial and industrial areas adjacent to residential zones, the <br />following conclusions can be drawn: <br /> <br />a. The general prohibitions against noise in the nuisance section of the <br />City Code are broad and should encompass any enforcement problems <br />but specific enforcement has proven to be difficult, especially after <br />nonnal working hours .and on weekends regarding sweeping, plowing <br />and garbage pick-up. <br />b. In the current code, specific hours for deliveries and refuse handling <br />are limited to regulating the residential zoning districts; yet, it is the <br />adjoining industrial and commercial properties that cause problems for <br />the residential areas. <br /> <br />3 <br />
