Back2round <br /> <br />Wally McCarthy Cadillac currently occupies a 6 acre site at 2325 Prior Avenue North. <br />The site is bounded by Prior Avenue on the east, the north service drive and Highway <br />35W on the south, Motel 6 on the west, and a Super 8 Motel on the north. Jerry <br />Moe/McCarthy Cadillac is requesting a variance to the City's parking setback <br />requirements to expand the existing customer parking/vehicle display area on the south <br />side (front) ofthe building. <br /> <br />2. Develooment Summary <br /> <br />The property under consideration is zoned B-3 General Business. Motor vehicle <br />dealerships are land uses allowed by conditional use permit in the B-3 General Business <br />district. (The City has previously approved a special use permit for the site so the use is in <br />conformance with the ordinance requirements.) <br /> <br />The applicant is requesting approval to expand the parking/vehicle display area between <br />the front of the building and the Highway 36 Frontage Road to expand the number of <br />parking/vehicle display spaces from 23 to 62. The applicant has indicated that there is <br />inadequate on-site parking which results in visitors and staff parking on Prior Avenue. <br />The addition of these spaces would eliminate the need to park on Prior Avenue and <br />provide adequate on-site parking for customers, sales and administrative staff, and <br />automobile display. The proposed parking lot would have a 5 foot setback from the <br />Highway 36 Service Road right-of-way. The actual parking surface would be <br />approximately 52 feet to 59 feet from the north edge of the actual service road. <br /> <br />3. City Code Requirements <br /> <br />The City Code, Section 1005.01, requires that parking be set back at least 15 feet from <br />any street right-of-way line. Therefore, a variance of 10 feet is required in this case. The <br />City Code, Section 1013.02, indicates that where there are practical difficulties or unusual <br />hardships in the way of carrying out the strict provisions of the code, City Council may <br />vary provisions in the code in harmony with the general purpose and intent thereof and <br />may impose additional conditions as it considers necessary so that the public health, safety, <br />and general welfare may be secured. <br /> <br />1 <br />
