<br /> <br />DATE: 04/22/96 <br />ITEM NO: 1-2 <br />Manager Approved: Agenda Section: <br />~ Reports <br />Item Description: LAKE OW ASSO NO- W AXE JOINT POWERS AND 150 <br />FOOT NO WAKE ZONE - Committee Formation <br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br /> <br />Background <br /> <br />1) After adopting a new Comprehensive Plan (1994) and a new shoreline <br />ordinance (1995), an ordinance (fall, 1995) was proposed to make the no-wake <br />zone on Roseville lakes consistent with the 1994 City of Shoreview 150 foot no- <br />wake ordinance. It appeared that there was both a 300 foot and 150 foot no- <br />wake setback on Lake Owasso. <br /> <br />2) The 300 foot no-wake setback used in Roseville is no longer allowed by the <br />MnDNR, yet it was "grandfathered" - a more restrictive law in existence <br />compared to the most recent state no-wake regulations. The State now allows <br />for a zero no-wake, a 100 foot no-wake, or a 150 foot no-wake setback zone on <br />the surface of the water. Changing the Roseville regulation (300 feet) would <br />mean that the city would have to comply with the less restrictive state <br />regulations (150 feet or less). <br /> <br />3) The current Roseville ordinance states that the no-wake setback is 300 feet. <br />The Shoreview ordinance now states that the no-wake setback is 150 feet on <br />Shoreview lakes. There is question whether this ordinance currently applies to <br />Lake Owasso, since the lake is in two cities and the cities did not adopt a joint <br />powers agreement stating that they agreed upon a common 150 foot no-wake <br />setback. The old "no-wakes" in both cities currently apply. <br /> <br />4) Because this issue was of interest to a large number of pro~e'"!Y owners and <br />users of Lake Owasso, the City Council requested staff to assIst ID a <br />neighborhood discussion (March 7, 1996) of the no-wake .inconsistencies on <br />Lake Owasso between the Cities of Shoreview and Rosevtlle. <br /> <br />1 <br />
