<br />10.4 PROGRESS PAYMENTS <br /> <br />Unless otherwise provided, partial payment documents will be prepared <br />by the Engineer for completed work on the project. Payment documents <br />will be prepared before the first of each month, and will be sub- <br />mitted to the Owner for approval before the 10th of the month. The <br />progress payments will be based on work completed and materials delivered <br />to the job site on or before the 20th of the preceding month. <br /> <br />The Contractor warrants and guarantees that the title to all work, <br />materials and equipment covered by a Progress Payment Document, will <br />have passed to the Owner prior to his signing of the Progress Payment <br />Document, free and clear of all liens, claims, security interests and <br />encumbrances (hereafter in these General Conditions referred to as <br />"liens"). <br /> <br />The Owner will, within ten days of presentation to him of an approved <br />Progress Payment Document, pay the Contractor 90~ of the amount approved <br />by the Engineer. <br /> <br />10.5 FINAL ACCEPTANCE OF WORK <br /> <br />The date of final acceptance of the work shall be the date of formal <br />acceptance by the City or other local government. <br /> <br />! <br />-, <br /> <br />If the work is not to be turned over to the City for ownership and <br />maintenance, the date of final acceptance shall be the date of acceptance <br />by the Engineer as evidenced in writing to the Owner. Such evidence <br />may be either a letter of final acceptance, or in the absence of such <br />a letter, a Final Payment Voucher indicating that the Engineer recommends <br />that no funds be retained. <br /> <br />I <br />I <br />J' <br /> <br />10.6 FINAL PAYHENT <br /> <br />Upon notice from the Contractor that the project is complete, the <br />Engineer will make a final inspection with the Owner and the Contractor. <br />Any items found to be defective during the inspection will be noted <br />and the Engineer shall furnish in writing to the Contractor a list of <br />such items that are defective or unfinished. The Contractor shall <br />immediately make such corrections as are necessary and to the satisfaction <br />of the Engineer. The Contractor may request final payment when all <br />corrective work is completed and all bonds, guarantees, certificates <br />of inspection and other documents have been delivered, all as required <br />by the Contract Documents. If the Engineer is satisfied that the work <br />has been completed and the Contractor has fulfilled all of his <br />obligations under the contract he will, within ten days after receipt <br />of the Contractor's notice of completion and request for final payment, <br />prepare the Final Payment Documents. <br /> <br /> <br />'. <br /> <br />In addition to the requirements of section 4.2 "Performance Bond," <br />the Owner may require separate releases of all claims and waivers of <br />all liens to be furnished by the Contractor before final payment is <br /> <br />GC-14 <br /> <br />
