<br />! <br />I <br /> <br />10.9 LIQUIDATED DAMAGES - CONT. <br /> <br />Permitting the Contractor to continue and finish the work or any part <br />of it after the time fixed for its completion may have been extended, <br />will in no way be construed as a waiver on the part of the Owner of <br />any of his rights under the Contract. <br /> <br />Neither by taking over the work by the Owner, nor by the annulment <br />of the contract, shall the Owner forfeit the right to recover <br />liquidated damages from the Contractor or his surety for failure to <br />complete the contract. <br /> <br />SECTION 11 SUSPENSION OF WORK <br /> <br />11.1 SUSPENSION OF WORK BY THE OWNER <br /> <br />The Owner may suspend the work, or any part thereof, for a stipulated <br />period of time by giving the Contractor thirty (JO) days written <br />notice. The Contractor may submit a request for extra compensation <br />for expense incurred by this suspension in accordance with the <br />provisions of Section 14.7, "Claims for Extra Costs". <br /> <br />The Engineer will have the authority to suspend the work ~holly or <br />in part for such periods as he may deem necessary, because of unsuit- <br />able weather or other conditions which are considered unfavorable <br />for the production of satisfactory work, or because of failure on the <br />part of the Contractor to carry out orders given or perform any or <br />all provisions of the Contract. No additional or extra compensation <br />or additional Contract time will be allowed due to suspension of <br />operations by the Engineer except as provided elsewhere herein. <br /> <br />In the event it should become necessary to stop work for an indefinite <br />period, the Contractor shall store all materials in such a manner <br />that they will not obstruct or impede traffic unecessarily nor be <br />damaged in any way, and he shall take every precaution to protect <br />from damage or deterioration all of the work performed. He shall <br />provide suitable drainage of the work by opening ditches, drains, <br />etc., and shall erect temporary structures where necessary. <br /> <br />11.2 TEMPORARY SUSPEHSIOH OF WORK DURING WINTER <br /> <br />Work will be allowed to proceed during the winter months provided <br />that all construction 'requirements are met. No additional compensation <br />will be allowed for costs incurred by the Contractor due to winter <br />suspension and for additional start-up in the spring except by special <br />agreement in writing between the Contractor and the Owner. <br /> <br />Unless specifically allowed in the Special Provisions or specifically <br />written into the Agreement or agreed upon in separate agreement by <br />and between the Owner and the Contractor, the Owner will not release <br />the retainer specified for, "Partial Payments," when work is suspended <br />due to winter conditions. <br /> <br />GC-16 <br />
