<br />12.2 CONTRACTORS RIGHT TO STOP WORK OR TERMINATE CONTRACT <br /> <br />If work is suspended for a period of more than ninety days by the <br />Owner through no fault of the Contractor, or the Engineer fails to <br />issue an estimate for payment within thirty days after it is due, or <br />the Owner fails to pay the Contractor a partial payment within thirty <br />days of its approval and presentation, then the Contractor may, upon <br />seven days, written to the Owner and Engineer, terminate the agree- <br />ment and recover from the Owner payment for all work executed and <br />any expense sustained plus a reasonable profit. In addition and in <br />lieu of terminating the Contract Agreement, if the Engineer has failed <br />to issue an estimate for payment or the Owner has failed to make any <br />payment as aforesaid, the Contractor may upon seven days written <br />notice to the Owner and the Engineer stop work until he has been paid <br />all amounts then due. <br /> <br />SECTION 13 - GUARANTEE <br /> <br />13.1 The Contractor shall hold himself responsible for any and all defects <br />which may develop in any part of the entire installation furnished by <br />him and, upon receipt of written notice from the Engineer, shall UDD- <br />ediately replace and make good without expense to the Owner such <br />faulty part of parts including damage resulting from same, during a <br />period of one (1) year from the date of final acceptance of the <br />installation, except when specific guarantee for another length of <br />time is specified elsewhere. <br /> <br />The acceptance of the installation, or any part of it, shall not act <br />to waive the liability on the part of the Contractor and his surety. <br /> <br />SECTION 14 - OTHER STIPULATIONS <br /> <br />14.1 ROYALTIES AND PATENTS <br /> <br />The Contractor shall pay all royalties and license fees. . He shall <br />defend suits and claims for infringement of any patent rights and <br />shall save the Owner harmless from loss on account thereof. <br /> <br />14.2 PERMITS, LICENSES AND REGULATIONS <br /> <br />Permits and licenses of a temporary nature necessary for the prose- <br />cution of the work shall be secured and paid for by the Contractor. <br />The Owner shall be responsible for permits, licenses and easements <br />for permanent structures or permanent changes in existing facilities <br />unless otherwise specified. The Owner shall make application for <br />permits for crossing highways and railroad prior to the letting. and <br />the Contractor shall obtain said permits and post any required bonds. <br /> <br />The Contractor shall be responsible for necessary notices to utility <br />companies, police and fire departments, etc.. and comply with all <br />laws, ordinances, rules and regulations bearing on the conduct of the <br />work as drawn and specified. <br /> <br />GC-18 <br /> <br /> <br />. ~ <br /> <br />I <br /> <br />
