<br />J <br /> <br />j <br /> <br />J <br /> <br />J.., <br />- <br /> <br />J <br /> <br />J <br /> <br />j <br />J <br />j <br /> <br />J <br />J <br /> <br />.J <br />J <br /> <br />J <br /> <br /> <br />14.10 ARBITRATION <br /> <br />Any questions in dispute under this contract may be submitted to <br />arbitration in accordance with the laws of the State of Minnesota <br />and shall be submitted prior to the issuance, by the Engineer, of <br />the Final Payment Voucher. Any dispute, claim or question not <br />submitted to arbitration prior to the. issuance of Final Payment <br />Voucher, and any question of procedu~e not agreed upon by both <br />parties may be submitted to a court .of competent jurdisdiction for <br />ruling. <br /> <br />~ <br /> <br />The Arbitration Board shall consist of three (3) members, one shall <br />be selected by each party, and the two so selected shall choose the <br />third, neutral arbitrator. The arbitrators shall be paid an amount <br />agreed upon by both parties. No one shall be selected or act as an <br />arbitrator who has a vested interest financial, competitive, or family <br />relationship with either party. <br /> <br /> <br />The Contractor shall prosecute the work during arbitration proceedings <br />except with the written permission of the Engineer and then only until <br />the arbitrators shall have an opportunity to determine whether or not <br />the work shall continue until they decide the matters in dispute. <br /> <br />Notice of the demand for arbitration of a dispute shall be in writing <br />to the Engineer and the other party to the Contract. If the arbit- <br />ration is an appeal from the Engineer's decision, demand shall be <br />made within ten (10) days of receipt of the Engineer's decision. In <br />any other case, the demand for arbitration shall be made within a <br />reasonable time after dispute has arisen. In no case shall a demand <br />be made after the final payment unless ottherwise stipulated in the <br />Contract Documents. <br /> <br /> <br />The arbitrators, if they deem the case requires it, are authorized to <br />award to the party whose contention is sustained such sums as they <br />deem proper to compensate for the time and expense incident to the <br />proceedings, and if the demand for arbitration was made without <br />reasonable cause, they may also award damages for..delay. .The arbit- <br />rators may assess upon either or both parties the cost of the <br />proceedings. <br /> <br />14.11 CLEANING UP AND RESTORATION <br /> <br />Surplus pipe, materials, tools, equipment and machinery shall be re- <br />moved from the site by the Contractor. All dirt, rubbish and excess <br />earth excavation shall be hauled to a dump site selected by the <br />Contractor, and the construction site shall be left clean to the <br />satisfaction of the Engineer. <br /> <br />The Contractor shall restore to their original condition all portions <br />of the site not designated for alteration under this contract. <br /> <br /> <br />r.r._'1 <br />
