I"TV <br />D~"&lAPM..Jr <br /> <br /> <br />DEVELOPMENT CONTRACT <br /> <br />PUBLIC IMPROVEMENT <br /> <br />AGREEMENT, dated this 2.5.:t.tPay of J'Une ,1996, by and between the CITY <br />OF ROSEVILLE, a Minnesota municipal corporation, ("City"), and Virginia and Frank Tschida, <br />a Minnesota Corporation, (the "Developer"). <br /> <br />1. Request for Plat Approval. The Developer has asked the City to approve a plat of land <br />to be known as Tschida Owasso Hills Fourth Addition (also referred to in this contract as <br />the "plat"). The land is legally described as follows: <br /> <br />Outlot A of Tschida Owasso Hills Plat No.3 excluding Block 1 of Cave's Owasso Hills, <br />Ramsey County, Minnesota. <br /> <br />2. Conditions of Plat Approval. <br /> <br />The City Council approved the preliminary plat request at 350 S. Owasso Boulevard with <br />an 80 foot front lot width and a 5 foot variance for the 6 lots on the cul-de-sac, a $500 <br />park/recreation cash dedication for each lot, and an 8% grade for Stanbridge Circle. <br /> <br />3. Effect of Subdivision Approval. For two (2) years from the date of this Contract, no <br />amendments to the City's Comprehensive Plan, except an amendment placing the plat in <br />the current urban service area, or official controls shall apply to or affect the use, <br />development density, lot size, lot layout or dedications of the approved plat unless <br />required by state or federal law or agreed to in writing by the City and the Developer. <br />Thereafter, notwithstanding anything in this Contract to the contrary, to the full extent <br />permitted by state law the City may require compliance with any amendments to the <br />City's Comprehensive Guide Plan, official controls, platting or dedication requirements <br />enacted after the date of this Contract. <br /> <br />4. Development Plans. The plat shall be developed in accordance with the attached plans <br />and specifically dated July 24, 1996 and signed by the City. The plans include: <br /> <br />A. Sanitary sewer and watermain. <br />B. Storm sewer and streets. <br />C Grading and erosion control. <br />D. Street lighting. <br /> <br />If the plans vary from the written terms of this Contract, the written terms shall control. <br /> <br />5. Installation by Developer. The Developer shall install or cause to be installed and pay <br />for the following: <br /> <br />A. Setting of Lot and Block Monuments <br />B. Surveying and Staking of work required to be performed by the Developer <br /> <br />I <br />
