<br />4. SITE INVESTIGATION <br /> <br />The bidder is solely responsible for having made field inspection and other site <br />investigations deemed necessary to completely construct the project in accordance with the <br />plans and specifications. Investigations of subsurface conditions is solely the responsibility <br />of the bidder. <br /> <br />5. OPENING OF PROPOSALS AND A WARD OF CONTRACT <br /> <br />The Owner reserves the right to open and consider the proposals at a time and place to be <br />designated by the Owner and to award a contract in the best interests of the Owner. <br /> <br />The right is reserved to award the contract and send the successful bidder the necessary <br />contract forms at any time within thirty days after the date on which proposals are received. <br /> <br />6. MODIFICATION OF PROPOSAL BY THE OWNER <br /> <br />The Owner reserves the right to modify the Plans, Specifications, Special Provisions or <br />Proposal for any individual project at any time, subject to the following conditions: <br /> <br />A. Such modification will be made by addendum, duly numbered and dated. <br /> <br />B. Such addendum will be mailed US mail or will be sent by telegram to each <br />prospective bidder who has received a Proposal prior to the date of the <br />addendum, and each such bidder shall acknowledge receipt of that addendum <br />on this Proposal fonn. <br /> <br />C. Such addendum will be attached to all specifications issued after the date of the <br />addendum and shall remain a part thereof. <br /> <br />7. STARTING AND COMPLETION DATES <br /> <br />All site utility and street work shall be completed as specified in contract agreement. <br /> <br />8. CONTRACTOR'S SCHEDULE <br /> <br />The Contractor shall prepare, with the assistance of the Engineer, a proposed schedule of <br />operations, It shall indicate the number, location and type of crews working and the <br />estimated dates of the starting and completion of various phases of the work. This schedule <br />shall be revised periodically to allow for changes that develop during the perfonnance of <br />the work. The Owner, through his Engineer, shall reserve the right to designate an order in <br />which construction is to proceed to coincide with his development schedule. <br /> <br />-2- <br />
