<br />The lot division does not place the existing house in violation of any setback requirements. <br />However, the existing garage and driveway do not meet current setbacks. The garage is setback <br />1.4 feet instead of 5 feet and the driveway is setback 3.5 feet instead of 5 feet. The house was <br />constructed in the 1930's and is considered a legal nonconforming use. The lot proposed to be <br />created for future development is large enough that a single family structure can be built on the <br />property within all setback requirements. <br /> <br />No park dedication is required for a division of a platted lot. <br /> <br />Engineer!ng Considerations: <br /> <br />1. A stonn sewer assessment in the amount of $5 59.17 must be paid for the lot division to be <br />approved. <br /> <br />2. The proposed new lot does not have a sanitary sewer service. The applicant should be <br />aware that the sanitary sewer main is located in the center of Chatsworth Street. There <br />may be significant expense involved in providing the lot with sanitary sewer service. A <br />sewer permit will be required to extend sewer to the property. <br /> <br />Summary and Conclusion: <br /> <br />The site under consideration is approximately 39,280 square feet in size and is zoned R-l, single <br />family residential. The proposed lot division would create a new family lot that would be <br />consistent with the City's zoning ordinance and Comprehensive Land Use Guide Plan. Both lots <br />would meet the minimum size and ftontage requirements for R-l development. The new dwelling <br />will not require variances for construction. The existing house is a legal nonconforming structure <br />and the proposedlot division will not increase the nonconformity. Staff recommends that the <br />Planning Commission recommend approval of Eleanora Reisinger Estate's request for a lot <br />division at 1850 Chatsworth subject to the applicant paying a stonn sewer assessment of $559.17. <br /> <br />2 <br />
