new pond in the northwest corner of the plat should each be within an outlot or
easement over the entire pond dedicated to the City of Roseville. The outlot
should cover all property within the 100-year flood plain of each pond. This may
create some difficulty for Lot 1, since the proposed pond is included as part of
Lot 1.

7. The utility plan shows existing 6-inch water and 8-inch sewer stub-outs. The
locations shown do not match with the locations shown on the City's as-builts.
The City's as-builts show the stubs located approximately 35 feet south of where
they are shown on the plans. An attempt should be made to align Acorn Lane
with the existing sub-outs. If this is not possible, the utilities will need to be
realigned within the right-of-way and easements provided in the plat.

8. A Suburban Development contract will be required to install the public
improvements. Plans and specifications must be approved by the City of
Roseville as part of the developer's contract. In addition, a surety in the amount
of 1 % times the estimated cost of the construction work will be required. The
City prefers the improvements to be constructed by the City rather than the
developer.

9. The proposed center island may not include any trees or other large objects
which would impede the movement of emergency vehicles across it. Also, no
utility boxes are allowed within the landscaped island.

10. Street lights will be required at both the intersection of Acorn Road and Acorn
Lane and also at the eastern end of the cul-de-sac. The cost of these items is
the responsibility of the applicant.

Staff Recommendation:

The property under consideration for the proposed Acorn Acres plat contains what v .
appears to be a wetland area on the north side of Acorn Lane, on what would be <<$" "~.
platted as Lots 1 and 2. Early on, staff asked the applicant to provide a wetland ~o ~@ \J ~J
delineation study and to contact the Army Corps of Engineers and the Rice Creek 0 ~~./;) ? ,!
Watershed District concerning this wetland area. To date, we have not received a A '~ ,~
wetland delineation study nor any preliminary comments from either of the other two llj
permitting agencies. Based on not having this critical information, staff recommends
that the Planning Commission continue the public hearing on the proposed Acorn Acres
plat to October 9, 1996.

Suggested Recommendations/Actions:

1. Motion to continue the public hearing on Arthur Mueller's request for plat

4
