CITY OF ROSEVILLE <br />AND RAMSEY COUNTY <br /> <br />Dear Council Members: <br /> <br />A company called Commercial Property Investments has commenced <br />litigation against the City of Roseville and Ramsey County. <br /> <br />They allege that they are the owners of property just North of <br />the present Ramsey County Library. What they are seeking is that <br />the County and the City commence eminent domain proceedings to <br />acquire their land. <br /> <br />Commercial property Investments also alleges that they are <br />affiliated with The Everest Group Ltd. and that C. William Franke <br />is the President of The Everest Group Ltd. <br /> <br />I have discussed this matter with Mr. Norman Vinnes, Director of <br />Ramsey County Library Services, and he informs me that the Ramsey <br />County Board has not as of this date, passed a resolution <br />ordering the County of Ramsey to commence condemnation <br />proceedings. Mr. Vinnes tells me that the Ramsey County Library <br />Board has recommended such action, however the final decision is <br />up to the Ramsey County Board, and as indicated, they have not as <br />yet acted. <br /> <br />The lawsuit against the City of Roseville appears to be nothing <br />more than a nuisance and an expenditure of funds to defend the <br />lawsuit. <br /> <br />I do not believe that the plaintiff can be successful in <br />receiving any affirmative action against the City of Roseville. <br /> <br />.......~~~~..~ <br />
