<br />;])k-tbFr <br />~- <br /> <br />Planning CoDlDlission Meeting Minutes <br />September II, 1996 <br /> <br />6(c) Planninl File 2859: Patrick Daulton request for a variance to the shoreland <br />ordinance at 3030 Little Bay Road. <br /> <br />Chairman Wietecki opened the hearing and requested MichaelFalk to SU1IlJIl8rize his <br />written report of 9/11/96. The applicant requests a 39 foot setback variance to allow a 36 <br />foot setback. Staff could not find a unique hardship and recoDlDlended denial. <br /> <br />Chairman Wietecki asked what is setback of house. (62 feet). <br /> <br />Member Cunningham asked for discussion/details of alternatives or could the pool set <br />back the same distance as the existing non-conforming house. <br /> <br />Member Harms asked for details.regarding other pools closer than 75 feet to the lake <br />shore. Falk noted there are no pool variances to date. <br /> <br />Member Rhody stated that the Daulton request regarding excavation of the bay, which <br />changed the setback, has no standing. <br /> <br />Patrick Daulton, 3030 Little Bay Road, stated that he bought the house in 1990 and found <br />that the shore was too mucky to swim. The muck came nom dredging. The MnDNR <br />will not allow sand fill on the beach. Neighbors support this proposal. There is no <br />property to the southeast. The proposed 14' x 28', 4 foot deep wading pool will not effect <br />the shore. Daulton stated the variance hardship was the dredging and the existing <br />location of the house. He said he would enclose the pool with a roof if necessary. <br /> <br />Member Sandstrom asked if the rock wall proposed was subject to the shoreland code. <br /> <br />Member Harms asked if there was room for a pool on the side yard, but with the same <br />setback as the existing house. There is a large pine tree in this area. <br /> <br />Mr. Daulton stated he had reviewed the alternatives and may consider some alternative in <br />the future. <br /> <br />Chairman Wietecld asked if there were coDlDlents from the public. There were none. <br /> <br />Chairman Wietecki closed the public hearing. <br /> <br />MOTION: Member Wietecki moved, seconded by Member Harms, to recoDlDlend <br />denial of Patrick Daulton's request for a 39 foot shoreland setback variance at 3030 Little <br /> <br />6 <br />
