Attached is a draft of an ordinance that would require churches and schools to follow the <br />provisions of a conditional use permit (and hearing) when establishing such a use in an "R-I" or <br />"R-2" zone. <br /> <br />2. The Planning Commission previously recommended that the city have more review opportunity <br />particularly when existing schools and churches expand in residential districts, Today such uses <br />are considered a permitted use, with no formal review process, This has caused numerous <br />problems with neighborhoods who find that they will be losing housings for parking and <br />oversized structures, without an opportunity to be heard on the topic unless a variance is <br />requested. The attached map illustrates that there are over 30 sites encompassing more than 263 <br />acres presently. As schools and churches continue to consolidate into larger complexes, there <br />will undoubtedly be more encroachments into the residential areas, particularly the single family <br />areas where parcels can be bought one at a time for later consolidation. <br /> <br />3. The draft ordinance simply shifts churches, schools, and similar buildings ftom the "permitted <br />use" category to the "conditional use" permit category in each residential zone. The churches <br />and schools are then subject to the city's design standards. <br /> <br />4. The Planning Commission, at the April 10, 1996 meeting, unanimously recommended <br />approval of the proposed ordinance amendment to Sections 1004 and 1010 of the City <br />Code stating that conditional use permits will be required for establishment and <br />expansion of churches and schools adjacent to residential zones. <br /> <br />Alternatives: <br /> <br />1. One alternative for the City Council to consider would be to create a new zoning district for <br />churches, schools, parks, open space, and cemeteries called an Oil zoning district (Open <br />Spacellnstitutional Use) wherein churches, schools, and cemeteries would be conditional uses; <br />parks and open space would be permitted uses. The churches, schools, and cemeteries would <br />also be subject to the city's design standards. To create and identify uses for such a new zoning <br />district, the city may be required to hold formal public hearings on each property whose zoning <br />designation would change. <br /> <br />2. Another alternative is to require all churches and schools to apply for a PUD. <br /> <br />1 <br />
