<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 8-26-96 <br /> <br />Dep~nt Approval: <br />---:\) t lfJ <br />Item Description: <br /> <br />ITEM NO.: <br />Agenda Section: <br />Reports and <br />Recommendations <br />APPROVAL OF FALL, 1996, YMCA GARAGE SALE <br /> <br />F- 3 <br /> <br /> <br />Baclq:round <br /> <br />The YMCA has requested approval of a special garage set up and sale promotion permit for the week <br />of September 18 through Sunday, September 22nd. <br /> <br />The City Code, Section 1004.01 I, states that a normal residential garage sale may be up to 3 days <br />long, three times during anyone calendar year. The sale must be held between the hours of 8:00 am <br />and 6:00 pm. For f:araf:e sales/promotions that will vary Horn those standards. the Code reQJlires <br />Council approval. <br /> <br />The YMCA sale varies in the following ways: <br /> <br />1) <br />2) <br />3) <br /> <br />It is longer than 3 days of sales (Wednesday, September 18th through Sunday, September <br />22nd). <br />The set up period will begin more than one day in advance of the sale (Sept. 14-17). <br />Because ofthe magnitude of this garage sale promotion, a portion of the items for sale will be <br />stored on the yard, not within the garage or screened areas. <br /> <br />From staff perspective, the YMCA SalelPromotion has been so successful that it has outgrown the <br />intent of residential garage sale section of the code. It has become more of an annual sale/celebration. <br />The purposes of the YMCA Sale Promotion are unique and valid; the location of such a community <br />event should be re-evaluated for each event. Last spring, the YMCA and City staff reviewed methods <br />in which community organizations and the City can jointly find a more appropriate location for such <br />events. Examples reviewed included City parks, City parking lots, joint use parking, adequate <br />pedestrian safety zones, signage, visibility, sanitary systems, lighting, and perhaps security. The <br />spring approval included notice to neighbors and a meeting with YMCA representatives. City <br />planning staff will again provide notice to neighbors of the impending Council decision and ask for <br />comments prior to or at the meeting. <br /> <br />Council Action Requested: <br /> <br />1. Receive comment Horn neighbors. <br /> <br />2. Motion to approve the 1996 fall YMCA Sale Promotion at 1170 W. County Road B, with <br />setup to occur Horn September 14-17, and sale to occur Horn Wednesday, September 18th <br />through Sunday, September 22nd (with the following conditions) as per the letter of July 26, <br />1996 Horn Robert Hengelfelt (with any conditions as Council may add). <br /> <br />a. Invite patrons to use the Lexington and County Road B parking lot. <br />b. Provide the City Manager and Attorney a Certificate of Insurance holding the City <br />harmless. <br />c.
