REQUEST FOR COUNCIL ACTION DATE: 04-27-98
ITEM NO:PF3014
ITEM NO.: c-4
Agenda Section:
Consent
APPROVAL OF SPRING, 1998 YMCA GARAGE SALE

Background: The YMCA has requested approval of a special garage set up and sale
promotion permit for Tuesday, May 12 through Sunday, May 17th, 1998.

The City Code, Section 1004.011, states that a normal residential garage sale may be
up to 3 days long , three times during anyone calendar year. The sale must be held
between the hours of 8:00 am and 6:00pm. For garage sales/promotions that will
vary from those standards, the Code requires Council approval.

The YMCA Sale varies in the following ways:

1) It is longer than 3 days of sales (Tuesday, May 12th through Sunday May 17th).
2) The set-up period will begin three days prior to the sale. (Saturday, May 9th)

3) Because of the magnitude of this garage sale promotion, a portion of the items
for sale will most likely be stored on the yard, not within the garage or screened
areas.

From the staff perspective, the YMCA Sale/Promotion has been so successful that it
has outgrown the intent of residential garage sale section of the code. It has become
more of an bi-annual sale/celebration. The purposes of the YMCA Sale/Promotion are
unique and valid; the location of such a community event should be re-evaluated in the
future. There should be some method in which community organizations and the city
can jointly find a more appropriate location for such events. Examples might include city
parks, city parking lots, joint use parking lots at shopping centers, church parking lots
and ball fields. Such sites may have more parking, adequate pedestrian safety zones,
signage, visibility, sanitary systems, lighting, and perhaps security.

No alternatives could be agreed upon that would solve problems. The organizers feel
they have created good will in the neighborhood and have had no neighborhood
complaints.

1
