Any manufacturing business. <br />barber shop or beauty shOP, dancing <br />or musical school with organized <br />classes of more than one pupil at a <br />time, commercial stable or kennel or <br />any actiVity producing noxious matter <br />or perceptible noise beyond the lot <br />line. (Ord. 758. 6-23-75) <br /> <br />" Garage And Boutique Sales In Resi- <br />dential DistrictS: <br /> <br />1. Restricted: Garage sales and resi- <br />dential boutique sales are permitted <br />accessOry uses in R-1, R-2. R-4, R-5 <br />and R-e Districts, but shall be limited <br />to three (3), three_consecutive-day <br />sales each calendar year per residen- <br />tial unit, and sha" not exceed nine (9) <br />total days in duration per year. No <br />single sale shall exceed three-consec- <br />utive-days in length. The maximum <br />daily hours of operation sha" be eight <br />o'clock (8:00) A.M. to six o'clock <br />(6:00) P.M. A residential boutique sale <br />sha" not occupy more than four hun- <br />dred (400) square feet of a residential <br />unit. <br /> <br />2. Definitions: For the purposes of this <br />Section, garage sales and residential <br />bOUtique sales are defined as follows: <br /> <br />GARAGE SALE: A sale of used <br />household and personal itemS con- <br />ducted on, residential premises, where <br />the property sold consists of itemS <br /> <br />1 004.01 <br /> <br /> <br />owned by the occupant of the premis- <br />es at which the sale takes place, or by <br />friends of such occupant and where <br />the sale is conducted by such occu- <br />pant or friends, and not by an agent or <br />any other person to whom a commis- <br />sion. fee or salary is paid. Items for <br />sale shall not have been purchased <br />for resale or received on consignment <br />for the purpose of resale. Except dur- <br />ing the sales day and one day before <br />and after for setup. itemS for sale <br />shall be stored within the garage, <br />screened from "Iew with opaque fenc- <br />ing or screening or stored in the ress- <br />dence. No permit is required for a sale <br />which meets the criteria of this Sec- <br />tion. A property owner may apply for a <br />garage sale promotion permit in which <br />the applicant requests the City coun- <br />cil to "ary or approve additional condi- <br />tions beyond those stated in this <br />code. <br /> <br />RESIDENTIAL BOUTlaUE SALE: The <br />sale of handcrafted itemS conducted <br />on residential premises. where the <br />itemS sold are made by the occupant <br />of the premises at whiCh the sale <br />takes place, or by friends of such <br />occupant, and where the sale Is con- <br />ducted by said occupant or friends of <br />such occupant and not by an agent or <br />any other person to whom a commis- <br />sion, tee or salary is paid. Items tor <br />sale shall be made in the home and <br />not purchased tor resale from any <br />retail or wholesale business source <br />nor received on consignment tor the <br />purpose at resale.
