The property is a part of the <br />Owasso Hills Residential Planned Unit Development. When the house was built, the <br />Ingison's constructed an inground pool in their back yard. The State Uniform Building <br />Code requires that a safety fence, 48 inches in height, completely enclosing a pool, <br />however, the City of Roseville has adopted a minimum height of at least 5 feet for a <br />fence enclosing a pool. The Ingison's house is located on a corner lot, giving it two <br />front yards. City codes require a maximum fence height of 48 inches to the 30 foot <br />building setback line. Beyond that point, the code allows fences to be a maximum of 6- <br />1/2 feet tall. In order to properly enclose their pool and provide service access to the <br />pool's mechanical equipment and to provide enough room for an egress window from <br />the lower level, Mr. Ingison would like to locate his fence 24 feet from the side property <br />line. For that 6 feet, Mr. Ingison is requesting a 1 foot variance to the fence height <br />along Owasso Hills Drive. <br /> <br />Variance Request Summary <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />48 inch maximum <br />fence height <br /> <br />5 foot fence height <br /> <br />1 foot height variance <br /> <br />In the Owasso Hills neighborhood, fences must be approved by the Neighborhood <br />Architectural Control Committee. Attached to this report is a letter from Dahlgren, <br />Shard low, and Uban with the Committee's response to Mr. Ingison's fence. Mr. Ingison <br />has agreed to all the conditions and has indicated to City staff that the required <br />landscape planting will take place in the spring. <br /> <br />The Minor Variance Committee has reviewed this request and has unanimously <br />recommended approval of a 1 foot height variance for the portion of Mr. Ingison's fence <br />that is set back less than 30 feet from the Owasso Hills Drive property line. It was the <br />Committee's belief that the City's requirement for a 5 foot fence, combined with <br />improved safety egress from the building and the difficulty in servicing the pool's <br /> <br />1 <br />
