<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: 12-16-96 <br /> <br />Department Approval: <br /> <br />Manager Reviewed: <br /> <br />ITEM NO.: <br />Agenda Section: <br /> <br />Consent <br />Item Description: Bob and Pam Magnuson request for a minor variance at Lot 1, <br />Block 1, Bonnie's Addition on the new Milton Street cul-de- <br />sac. <br /> <br />Background <br /> <br />Bob and Pam Magnuson are proposing to build a new home on a newly created lot in a <br />subdivision around the west half of the recently improved Milton Street cul-de-sac. <br />Pending the resolution of a legal description problem, Bonnie's Addition should be <br />recorded at Ramsey County in the near future. The property is zoned R-1 Single <br />Family and is guided for low density residential development in the City's <br />Comprehensive Land Use Guide Plan. The lot under consideration is a pie-shaped lot <br />that has a 30 foot drainage easement that efffectively encumbers 60 feet of the north <br />yard. In order to build the house they have designed, the Magnuson's would like to <br />angle the footprint of the building on the lot in order to avoid this easement. In so <br />doing, they encroach on the rear yard setback requirement. <br /> <br />Variance Request Summary <br /> <br />Requirement <br /> <br />Proposal <br /> <br />Variance <br /> <br />30 foot rear yard setback <br /> <br />15 foot rear yard setback <br /> <br />15 foot variance <br /> <br />The Minor Variance Committee has reviewed this request and has unanimously <br />recommended approval of the 15 foot rear yard setback variance to allow for the <br />construction of a new home on this lot. It was the Committee's belief that the 30 foot <br />drainage easement is a significant hardship for this particular lot. By angling the house, <br />the building footprint can meet the sideyard setbacks, front yard setbacks, and avoid <br />the easement. It does, however, encroach 15 feet into the rear yard setback <br />requirement, necessitating a 15 foot rear yard setback variance. The affected <br />neighboring property to the rear is an exceptionally deep lot. The house on that lot <br />would be in excess of 400 feet from the proposed location of the Magnuson house. <br /> <br />A final plat for this site has not been approved or filed at the County. All other setbacks <br />would be complied with, including 10 foot side yard and 30 foot front yard setbacks, as <br />well as a 5 foot driveway setback from the property line. <br /> <br />1 <br />
