Business Items (Action Items) <br />2 <br />a.Request by the Community Development Department for a Text Amendment to <br />3 <br />the Commercial and Mixed Use Districts Section of the Zoning Ordinance, <br />4 <br />Specifically Table 1005-1 regarding Residential, Civic and Institutional Uses <br />5 <br />6 City Planner Thomas Paschke briefly reviewed this request of text amendments <br />7 recommended by staff, and as detailed in the RCA dated July 14, 2014. At the <br />8 request of Mayor Roe, Mr. Paschke displayed Table 1005-1 and highlighted proposed <br />9 amendments. <br />10 Based on her personal review, Councilmember McGehee questioned why student <br />11 housing was proposed as a permitted use in Community Business (CB) and Regional <br />12 Business-1 (RB-1) and -2 (RB-2) Districts, but not post-secondary colleges. <br />13 Councilmember McGehee opined that previous discussions were specific to office <br />14 based colleges or secondary schools, but not actual campuses in those districts. <br />15 Also, under the live-work units in RB-1 and RB-2 Districts, Councilmember <br />16 McGehee opined that those would not be suitable for student housing. <br />17 Mayor Roe clarified that those permitted uses were not changed from the current use <br />18 table, but only added as permitted uses in the CB Districts. <br />19 Mr. Paschke further clarified that this was what was approved with the recent <br />20 University of Northwestern land use application, moving from dormitory to student <br />21 housing, and permitted in CB, RB-1 and RB-2 Districts, and Community Mixed Use <br />22(CMU) Districts as approved conditionally, but not permitted in Neighborhood <br />23 Business (NB) Districts). <br />24 Mayor Roe sought further clarification related to the University of Northwestern <br />25 application and rezoning the former Comfort Inn and Suites to RB to allow dorms as <br />26 a permitted use, which to him seemed contrary to Mr. Paschke's last statement. <br />27 City Manager Trudgeon clarified that the change was from "dorms" which were <br />28 permitted on college campuses, to "student housing." Mr. Trudgeon advised that this <br />29 had created a conflict with City Code and definition, which still had dorms listed as <br />30 not permitted. <br />31 Mr. Paschke concurred, noting that the standards and definitions sections were <br />32 changed accordingly. <br />33 In now reviewing this as a whole, Councilmember McGehee stated that she didn't see <br />34 the point in permitting student housing in business districts; while she had no problem <br />35 allowing office-based campuses as previously discussed, but not straight-forward <br />36 student housing in these areas as it is currently shown. Councilmember McGehee <br />37 opined that she didn?t find it appropriate and found a Conditional Use more feasible <br />38 than opening student housing to all business areas. <br /> <br />
