PATHWAY EASEMENT THIS INDENTURE, made this I ~ ~ day of 1Iff7..1 L , 1998, by and between RYAN COMPANIES US, INC., a Minnesota corporation ("Owner"), and the CITY OF ROSEVILLE, a Minnesota municipal corporation ("City"); WITNESSETH: That in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration in hand paid by the City, Owner does hereby grant and convey unto the City, its successors and assigns, a perpetual easement for public walkway and bicycle pathway purposes over, upon and across the following described property in Ramsey County, Minnesota: A strip of land, eight (8) feet in width, within Lot 1, Block 3, Centre Pointe Business Park, according to the recorded plat thereof, Ramsey County, Minnesota, the centerline of which is described as follows: Commencing at the northeast comer of said Lot 1; thence South 00 degrees 00 minutes 00 seconds West, assumed bearing, along the east line of said Lot 1; a distance of 280.00 feet; thence North 90 degrees 00 minutes 00 seconds West, a distance of 4.46 feet to the beginning of the centerJine to be described; thence South 00 degrees 20 minutes 15 seconds East, a distance of 12.68 feet; thence South 03 degrees 32 minutes 56 seconds East, a distance of 69.59 feet to the east line of said Lqt 1 and said centerline there terminating. The sidelines of said strip of land are to be prolonged or shortened to terminate at said north and east lines of said Lot 1. ALSO A strip of land, eight (8) feet in width, within Lots 1 and 2, Block 3, Centre Pointe Business Park, according to the recorded plat thereof, Ramsey County, Minnesota, the centerline of which is described as follows: Commencing at the southeast comer of said Lot 2; thence North 00 degrees 00 ' minutes 00 seconds West, assumed bearing, along the east line of said Lot 2, a distance of 66.86 feet to the beginning of the centerline to be described; thence North 07 degrees 03 minutes 28 seconds West, a distance of 51.00 feet; thence North 00 degrees 04 minutes 18 seconds West, a distance of 372.52 feet; thence northeasterly along a tangential curve, concave to the southeast, having a central angle of 23 degrees 18 minutes 02 seconds and a radius of 83.06 feet for an arc distance of 33.78 feet to the east line of said Lot 1 and said centerline there terminating. The sidelines of said strip of land are to be prolonged or shortened to terminate at said east lines of said Lot 1 and Lot 2.
