<br />...' <br /> <br />r.~ <br /> <br />PATHWAY EASEMENT <br /> <br />THIS INDENTURE, made this ~ day of <(~c.- , 1998, by and between <br />EHLERS AND ASSOCIATES, INC., a Minnesota corporation ("Owner"), and the CITY OF <br />ROSEVILLE, a Minnesota municipal corporation ("City"); <br /> <br />WI1NESSETH: <br /> <br />That in consideration of the sum of One Dollar ($1.00) and other good and valuable <br />consideration in hand paid by the City, Owner does hereby grant and convey unto the City, its <br />successors and assigns, a perpetual easement for public walkway and bicycle pathway purposes <br />over, upon and across the following described property in Ramsey County, Minnesota: <br /> <br />A strip of land, eight (8) feet in width, within Lot 1, Block 2, Centre Pointe <br />Business Park, according to the recorded plat thereof, Ramsey County, <br />Minnesota, the centerline of which is described as follows: <br /> <br />Commencing at the most southerly comer of said Lot 1; thence on an assumed <br />bearing of North 45 degrees 00 minutes 00 seconds West, along the southwesterly <br />line of said Lot 1, a distance of 17.61 feet to the point of beginning of the <br />centerline to be described; thence North 1 degree 51 minutes 39 seconds West a <br />distance of 30.83 feet; thence North 16 degrees 24 minutes 32 seconds East a <br />distance of 34.05 feet; thence northerly a distance of 23.66 feet along a tangential <br />curve concave to the west having a radius of 78.00 feet and a central angel of 17 <br />degrees 22 minutes 49 seconds; thence North 0 degree 58 minutes 17 seconds <br />West, tangent to said curve, a distance of 106.09 feet; thence northerly a distance <br />of 84.34 feet along a tangential curve concave to the west having a radius of <br />702.48 feet and a central angle of 6 degrees 52 minutes 34 seconds; thence North <br />7 degrees 50 minutes 51 seconds West, tangent to last described curve, a distance <br />of 44.51 feet; thence northerly a distance of 59.45 feet along a tangential curve <br />concave to the southwest having a radius of 140.00 feet and a central angle of 24 <br />degrees 19 minutes 52 seconds; thence northerly a distance of 19.64 feet on a <br />reverse curve concave to the northeast having a radius of 35.00 feet and a central <br />angle of 32 degrees 08 minutes 35 seconds to the north line of said Lot 1 and said <br />centerline there tenninating. <br /> <br />The sidelines of said strip of land are to be prolonged or shortened to terminate at <br />said northerly and southwesterly lines of said Lot 1. <br /> <br />A drawing showing said easement premises is attached hereto and made a part hereof. <br /> <br />TO HA VE AND TO HOLD THE SAME, together with all the hereditaments and <br />appurtenances thereunto belong, or in an anywise appertaining, to the City, its successors and <br />assigns, forever. <br />
