Mr. Dennis Welsch
Centre Pointe Business Park
Proposed Planned Unit Deve10pnmt Agrccmcnt
April 30. 1997

The size of the project identification signs shall not exceed 9 12 feet in height by ~ 10
feet in width.

Paragraph 23

We suggest the "exception" language for hotels and restaurants be added to this paragraph. We
suggest the following language:

Excq>tion: hotel and restaurant architecture concernina communication equipment for
private use shall be constructed as per drawings approved on April 11. 1997.

Paragraph 15

We suggest the definition of "bar" be slightly revised per the following:

For purposes of this PUD, the bar shall include standing and seating area/stools within 10 .
feet of the front m: side or ether poolie ~ 8fe& of the bar.

Paragraph 32

As in paragraph 7, section 2 we believe "building" definition and permitted "uses" are not
sufficiently distinguished. We S1Jggest that the permitted uses be taken from the City's B-4 zoning
district as amended earlier in this correspondence and found in paragraph 7, section 2.

We suggest the following language for building definition:

Lot 4 of Block lofCentre Pointe 2nd Addition (northern most lot of new plat) shall be
designated for one story office, office/showroom. manufacturing and research and
development buildings only.

Paragraph 34

We are concerned this paragraph requires actions by "the developer" or a "service district" that
will need the permit of public agencies outside the City's jurisdiction. It is possible, given the
current language of paragraph 34, that "the developer" or "service district" could not fulfill the
provisions of condition 34. As a result we suggest the, following language:

The eeveleper aMler a service district and/or a s.pecial assessment to benefitins
commercial and industrial properties shall acquire, 8B4-pay, and/or construct (subject to
engineering and landscaping approvals) the following:

4
