<br />.. <br />...r. t" <br /> <br />oJ <br />:-. ~:I;: ~ <br /> <br />PATHWAY EASEMENT <br /> <br />TillS INDENTURE, made this Illvt day of h~-t-t , 1998, by and between <br />IDEAL PROPERTIES, L.L.P., a Minnesota limited liability partnership ("Owner"), and the <br />CITY OF ROSEVILLE, a Minnesota municipal corporation ("City"); <br /> <br />WITNESSETH: <br /> <br />That in consideration of the sum of One Dollar ($1.00) and other good and valuable <br />consideration in hand paid by the City, Owner does hereby grant and convey unto the City, its <br />successors and assigns, a perpetual easement for public walkway and bicycle pathway purposes <br />,over, upon and across the following described property in Ramsey County, Minnesota: <br /> <br />A strip of land, eight (8) feet in width; within Lot 3, Block 2, Centre Pointe <br />Business Park, according to the recorded plat thereof, Ramsey County, <br />Minnesota, the centerline of which is described as follows: <br /> <br />Commencing at the most northerly comer of said Lot 3; thence South 45 degrees <br />00 minutes 00 seconds East, assumed bearing, along the northeasterly line of said <br />Lot 3 a distance of 182.64 feet to the beginning of the centerline to be described; <br />thence South 00 degrees 40 minutes 12 seconds West a distance of 311.28 feet; <br />thence southwesterly along a tangential curve concave to the northwest having a <br />central angle of 47 degrees 19 minutes 43 seconds and a radius of 15.00 feet for <br />an arc distance of 12.39 feet; thence South 43 degrees 11 minutes 31 seconds <br />West, tangent to said curve, a distance of 5.46 feet; thence southerly along a <br />tangential curve concave to the southeast having a central angle of 39 degrees 45 <br />minutes 45 seconds and a radius of 15.00 feet for an arc distance of 10.41 feet; <br />thence South 03 degrees 25 minutes 45 seconds West, tangent to said curve, a <br />distance of 13.77 feet to the south line of said Lot 3 and said centerline there <br />terminating. <br /> <br />The sidelines of said strip of land are to be prolonged or shortened to tenninate at <br />said northeasterly and south lines of said Lot 3. <br /> <br />A drawing showing said easement premises is attached hereto and made a part hereof. <br /> <br />TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and <br />appurtenances thereunto belong, or in an anywise appertaining, to the City, its successors and <br />assigns, forever. <br /> <br />The City covenants and agrees to at its expense keep and maintain the pathway located on <br />such easement premises in good condition and state of repair. <br /> <br />.
